Editor for Mandala V3 — Terms of Use
Please read these Terms of Use (“Terms”) carefully before using the Editor for Mandala V3 mobile application (the “App”) operated by Oregon Code & Design, LLC (“we,” “us,” or “our”).
Acceptance of terms
By downloading, installing, or using the App, you agree to be bound by these Terms and by Apple’s Licensed Application End User License Agreement, which applies to every app downloaded from the App Store. If you do not agree to these Terms, do not use the App.
An unofficial app
The App is an independent community tool. It is not made, endorsed, or supported by Synesthesia Corp. Mandala is a trademark of Synesthesia Corp., used here only to describe the hardware the App works with. For support with the pads themselves, contact Synesthesia Corp. For support with the App, contact us.
License
The App is free. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, subject to these Terms and the App Store’s usage rules. You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse-engineer or attempt to extract the source code.
Writing to your hardware
Sending from the App writes settings directly to your pads, replacing what was stored on them. You use this feature at your own risk. Export your presets first if you want a backup. We are not responsible for lost pad settings, or for any effect on your hardware, its warranty, or its support from the manufacturer.
Intellectual property
The App and its original content, features, functionality, and design — including the Editor for Mandala V3 icon and visual designs — are owned by Oregon Code & Design, LLC and are protected by copyright, trademark, and other intellectual property laws. Trademarks of other companies belong to their owners.
Disclaimer of warranties
The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the App will work with every pad, firmware version, or device, or that it will be free of errors.
Limitation of liability
To the fullest extent permitted by applicable law, Oregon Code & Design, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, settings, profits, or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the App.
Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason. Upon termination, your right to use the App will immediately cease.
Changes to terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continuing to use the App after an update means you accept the new Terms.
Governing law
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to conflict of law provisions.
