Backwords — Terms of Use
Please read these Terms of Use (“Terms”) carefully before using the Backwords mobile application (the “App”) operated by Oregon Code & Design, LLC (“we,” “us,” or “our”).
Acceptance of terms
By downloading, installing, or using the App, you agree to be bound by these Terms and by Apple’s Licensed Application End User License Agreement, which applies to every app downloaded from the App Store. If you do not agree to these Terms, do not use the App.
License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your personal, non-commercial use, subject to these Terms and the App Store’s usage rules. You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse-engineer or attempt to extract the source code.
Your recordings
You own what you record. You are responsible for what you record and share, including having the consent of anyone else whose voice you capture. We have no access to your recordings and no obligation to store or recover them.
Intellectual property
The App and its original content, features, functionality, and design — including the phrase packs, the Backwords name and mark, and the visual designs — are owned by Oregon Code & Design, LLC and are protected by international copyright, trademark, and other intellectual property laws.
Purchases
The full version and phrase packs are one-time purchases made through Apple. Prices are shown in the App before you buy. Refunds are handled by Apple under App Store policy. Restore Purchases in Settings brings your purchases to a new device signed into the same Apple Account.
Acceptable use
You agree to use the App only for its intended purpose as a party game. You may not use the App to harass, impersonate, or defame anyone, to record people without their consent where consent is required, or in any way that violates applicable laws or regulations.
Disclaimer of warranties
The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the App will be free of errors or available at all times.
Limitation of liability
To the fullest extent permitted by applicable law, Oregon Code & Design, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of recordings, data, profits, or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the App. Back up anything you care about.
Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason. Upon termination, your right to use the App will immediately cease.
Changes to terms
We may update these Terms with an App update. Changes will be reflected in the App with an updated effective date and posted on this page. Continuing to use the App after an update means you accept the new Terms.
Governing law
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to conflict of law provisions.
